Este real decreto deroga y sustituye al anterior Real Decreto 551/2006, de 5 de mayo, por el que se regulan las operaciones de transporte de mercancías peligrosas por carretera en territorio español, que incorporaba al Derecho español la Directiva 94/55/CE del Consejo, de 21 de noviembre, sobre aproximación de las legislaciones de los Estados miembros con respecto al transporte de mercancías peligrosas por carretera.
Desde la entrada en vigor del citado Real Decreto 551/2006 se han producido diversas modificaciones en esta materia en la normativa comunitaria e internacional. Por un lado, la Directiva 2008/68/CE del Parlamento Europeo y del Consejo, de 24 de septiembre de 2008, sobre el transporte terrestre de mercancías peligrosas ha venido a refundir las anteriores Directivas 94/55/CE del Consejo, de 21 de noviembre, sobre aproximación de las legislaciones de los Estados miembros con respecto al transporte de mercancías peligrosas por carretera, y la 96/49/CE de 23 de julio, del Consejo, sobre aproximación de las legislaciones de los Estados miembros relativas al transporte de mercancías peligrosas por ferrocarril.
Este real decreto transpone la citada Directiva 2008/68/CE en lo que afecta al transporte por carretera.
