El Boletín Oficial del Estado del día 8 de abril de 2014 publica la Ley 6/2014, de 7 de abril, por la que se modifica el texto articulado de la Ley sobre Tráfico, Circulación de vehículos a Motor y Seguridad Vial.La norma ha entrado en vigor el día 9 de mayo de 2014.
Tras las novedades legales, habrá que tener en cuenta los siguientes aspectos:
I. Inmovilizaciones
Dispositivos de retención infantil. Los agentes de la autoridad podrán proceder a la inmovilización del vehículo cuando se acredite que menores de edad susceptibles de ello no hacen uso del dispositivo de retención infantil, tanto en vías urbanas como interurbanas.
Conducción de vehículos para los que se exige permiso C o D. El apartado k) del precepto legal señal como causa de la inmovilización la conducción de “un vehículo para el que se exige permiso de la clase C o D, careciendo de la autorización administrativa correspondiente”.
II. Bebidas alcohólicas y drogas.
En la parte relativa a alcohol no hay modificaciones, pero el nuevo artículo 12 consagra como prohibición general la
presencia de drogas en el organismo de las que quedan excluidas aquellas substancias que se utilicen bajo prescripción facultativa y con una finalidad terapéutica.
La prohibición de la presencia de drogas en el organismo del conductor permite diferenciar de forma clara el ilícito en vía administrativa respecto del delito tipificado en el artículo 379.2 del Código Penal, cuyo objeto es la prohibición de conducir bajo la influencia de drogas tóxicas, estupefacientes o sustancias psicotrópicas.
Dado que los controles de drogas que se han venido realizando en los últimos años se basan en la detección de la presencia de drogas utilizando para ello pruebas salivales, la Instrucción 12/TV-73 sigue siendo aplicable en cualquiera de
las alternativas que en ella se contiene.
Substancias. El artículo 12 de la Ley excluye de su objeto de prohibición los casos de consumo de substancias que se utilicen bajo prescripción facultativa y con una finalidad terapéutica, siempre que se esté en condiciones de utilizar el vehículo conforme a la obligación de diligencia, precaución y no distracción establecida en el artículo 9. Debe significarse que esta exclusión opera sólo para la vía administrativa, por lo que no prejuzga la comisión de un posible delito de conducción bajo la influencia de drogas tóxicas, estupefacientes o sustancias psicotrópicas tipificado en
el artículo 379.2 del Código Penal.
En caso de que junto a substancias utilizadas bajo prescripción facultativa en las pruebas de detección de drogas se detecten otras substancias que si están prohibidas, se estará ante una posible infracción administrativa o ante un delito,
según el caso.
Sanciones en materia de alcohol. El artículo 67.2.a) indica, en el caso de conducción con tasas de alcohol superiores a las que reglamentariamente se establezcan, la posibilidad de que la sanción a aplicar sea de 1.000 euros. Los casos
en los que corresponderá esta sanción son los siguientes:
a) Conductores sancionados en el año inmediatamente anterior. Los conductores que sean sancionados por cometer, a partir de la entrada en vigor de la
ley, una infracción al artículo 20 del Reglamento General de Circulación, en caso de volver a ser denunciados por este mismo precepto en el plazo de 1 año, serán sancionados con multa de 1.000 euros. La sanción podrá haber sido impuesta por cualquier Administración con competencia en materia de tráfico, deberá constar anotada en el Registro de Conductores e Infractores y será visible para agentes e instructores a través del aplicativo ATEX.
En el citado Registro figurará durante un año la anotación de antecedentes por sanción firme por infracción al artículo 20, a los efectos indicados, de forma que los agentes de la autoridad y los instructores de los procedimientos sancionadores puedan visualizar la anotación.
b) Tasa doble de la permitida. La expresión de tasa doble de la permitida se refiere a cada una de las tasas contempladas en el artículo 20 del Reglamento General de Circulación, en función del vehículo que se conduzca.
III. Auxilio en carretera.
El artículo 25 establece que “Tendrán prioridad de paso sobre los demás vehículos y otros usuarios de la vía los vehículos de servicio de urgencia públicos o privados, cuando se hallen en servicio de tal carácter, así como los equipos de mantenimiento de las instalaciones y de la infraestructura de la vía y los vehículos que acudan a realizar un servicio de auxilio en carretera”.
La principal novedad que se introduce en el precepto es la relativa a los vehículos de auxilio en carretera, y por este motivo se deberá tener en cuenta lo siguiente:
1. La prioridad de paso prevista en el artículo citado en modo alguno supone que se conviertan en vehículos prioritarios.
2. La prioridad de paso sólo alcanza al vehículo de auxilio en carretera que de forma cierta acuda a un servicio por haber sido requerido para ello.
En caso de duda, los agentes requerirán a la grúa de auxilio en carretera que acredite que es quien verdaderamente ha sido llamada para realizar el servicio de auxilio.
IV. Otros aspectos que entran en vigor con la reforma de la Ley.
Además de lo ya expuesto, entran en vigor el 9 de mayo los siguientes aspectos:
Prohibición de uso de mecanismos de detección de radares o cinemómetros (art. 11.6). La Instrucción S/06-83, sobre “sistemas antirradar” explica los criterios de diferenciación de los mecanismos válidos y/o prohibidos.
Prohibición de adelantamientos poniendo en peligro o entorpeciendo a ciclistas que circulen en sentido contrario, incluso si esos ciclistas circulan por el arcén (art. 34.4).
Permitir las paradas o estacionamientos de grúas de auxilio en carretera por tiempo indispensable para efectuar la retirada de vehículos averiados o accidentados (art. 38.1).
Obligación de uso de casco de protección para ciclistas menores de 16 años en vías urbanas, interurbanas y en travesías, ampliando así la obligatoriedad actualmente existente para todos los ciclistas que circulan en vías interurbanas (art. 47.1).
